I think Kid is

in TRC, the smarter will be able to catch the other

shinichi is smarter...

also, shinichi doesn't want to catch kaito and put him in jail, he just wants to prevent him from completing his theft. if kaito does a trick, shinichi figures it out then he wins, basically, conan has won every almost all of his bouts with kid. shinichi knows kaito isn't doing it just to steal stuff, thus not wanting to catch him.. besides.. kaito knows conan=shinichi and has kept it a secret, conan isn't going to catch kid nor reveal his identity(he already knows who kaito kid is)

I think Shinichi is smarter, or they are exactly at the same level.
Shinichi just can't catch Kid, because of his shrunken body...

KID, his deductive powers are greater, he's more creative, and he can generally out-smart Shinichi with even the simplest of tricks.

Ex. Black Star case-KID used the his feelings for Ran to make Conan choose to save her from the cold night air instead of chase KID. Also in this case, KID figured out who had the real Black Star with less clues.
Miracle Mid-Air Walk case-Conan still doesn't know KID got scortched at the end, he thinks KID flew away. Where's the proof of that? Here:
The Four Masterpieces case-Conan kicks one of the special balls from his belt directly at KID and still thinks KID flew away, even though KID was just under the window cursing Conan.

Also, where is there any proof Shinichi knows who KID is? As a result of the Black Star case, there's no doubt KID knows Conan's Shinichi (the trick with Ran wouldn't have worked if he didn't), but there's no proof Conan knows who KID is. The only people who know are Kaito (duh), Jii, Kaito's mom, Akako, Saguru, Yusaku probably suspects it, and the Boss of the BO (assuming the Boss isn't someone who was already mentioned here) probably suspects it too, but that's it. No one else knows that Kaito is KID.

Shinichi is smarter (obviously) although Kid's not that behind compared to shinichi's "smartness".
